First Landlord Convicted of Obstructing Tax Investigation

IRAS publication date:

Rental-income and evidence issues

Huang Jian omitted S$55,965 of rent from three jointly owned properties in YA 2009–2012, leaving S$2,850 of tax undercharged. She also provided an incorrect bank statement to support a mortgage-interest deduction.

Obstruction and court outcome

During a September 2016 inspection she refused cooperation, locked herself in a bedroom and threw relevant documents from a window. IRAS reported the first obstruction conviction and total fines/penalties of S$14,160, reflecting a State Courts update dated 1 December 2021.

The release’s wider point

The report also discussed evidence supporting rental deductions and cooperation with investigators. Its offence and sentencing dates concern this historical case.

Rental expenses discussed in the release

The release explains net rental-income taxation after allowable expenses incurred during the tenancy. Examples include property tax, maintenance, fire insurance and mortgage interest. It describes a 15% deemed-expense option for residential letting, with actual mortgage interest claimed separately, or actual allowable expenses instead. Supporting records for actual claims must be kept for the stated five years. A deemed deduction does not legitimise forged invoices for additional amounts.

Disclosure, reporting and rewards

IRAS encourages taxpayers to correct past errors and report suspected tax malpractices. The release says disclosure may be considered when deciding enforcement action; it is not a blanket promise of immunity. Where the release describes informant rewards, qualifying information leading to otherwise lost tax recovery may attract 15% of recovered tax, capped at S$100,000, at IRAS’ discretion. Informant identities are kept confidential. Use the official release links for its reporting and disclosure channels.
