Nightclub Business Partner Sentenced to 3 weeks’ Jail and $339,420 Penalties for Under-reporting Income and GST

IRAS publication date:

Case and status

Century 21st Night Club precedent partner Goh Kim Teck received three weeks’ imprisonment and S$347,920 fines and penalties. Cash flower-garland sales were omitted from accounts. For YA 2013 he reported a partnership loss of S$57,812 instead of profit of S$128,772, causing S$16,519 of income tax undercharged.

Facts, amounts and outcome

One proceeded income-tax count attracted S$49,557 penalties, with three similar counts considered. Six GST counts involved S$144,931 output tax understated during 2013–2014, attracting S$289,863 penalties and S$8,500 fines; six similar GST counts were considered. The GST offences concerned understatement without reasonable excuse, distinct from the deliberate income-tax evasion charge.

Disclosure, reporting and rewards

IRAS encourages taxpayers to correct past errors and report suspected tax malpractices. The release says disclosure may be considered when deciding enforcement action; it is not a blanket promise of immunity. Where the release describes informant rewards, qualifying information leading to otherwise lost tax recovery may attract 15% of recovered tax, capped at S$100,000, at IRAS’ discretion. Informant identities are kept confidential. Use the official release links for its reporting and disclosure channels.
