Sole Proprietor Penalised for Under-declaring More Than $2 Million in Income

IRAS publication date:

Expenses behind the understatement

Kong Heng Metal Polishing proprietor Ng Sen Yoon understated more than S$2 million of income in YA 2009–2012, leaving S$461,753 of tax undercharged. The release identified S$2,265,693 of non-deductible private, capital and unsupported expenses.

Court outcome

He pleaded guilty to four proceeded charges of giving incorrect tax-liability information without reasonable excuse. The court imposed S$16,000 in fines and a S$923,506 penalty. The case distinguished accounting entries from expenses allowable for tax purposes.

Disclosure, reporting and rewards

IRAS encourages taxpayers to correct past errors and report suspected tax malpractices. The release says disclosure may be considered when deciding enforcement action; it is not a blanket promise of immunity. Where the release describes informant rewards, qualifying information leading to otherwise lost tax recovery may attract 15% of recovered tax, capped at S$100,000, at IRAS’ discretion. Informant identities are kept confidential. Use the official release links for its reporting and disclosure channels.
