Trustee and accompanying developer undertaking
Under 2013 housing-developer remission rule 3(2 D)(b), trustee for a qualifying developer of five-or-more housing units supplies this separate undertaking. Identify authorised signatory/ID, trustee company if relevant, developer, site/land, date and designation. Refer to the developer’s signed undertaking date and ensure compliance with it; this one-page trustee form supplements rather than replaces that detailed letter.
Recovery obligations
Developer-letter commencement/completion/document breaches(a),(b),(d) trigger full remittedABSD recovery; sale breach(c) triggers its(e)(ii) calculation, equal to or less than full remission. Trustee pays government debt with 5% yearly interest from 14 days afterTransactionDate. The trustee form incorporates the developer’s calculation rather than repeating a percentage table; consult that letter for sale-only clawback.
Transaction date and payment notice
TransactionDate is purchase contract/agreement or transfer, earlier, or applicable collective-sale order, referring to rule 3(3). Pay at place/manner inCommissioner notice within one month of service on trustee/company. Notice receipt determines payment deadline, not the start of interest.
One aggregate recovery and signature
The footnote expressly limits total recovery to one set of remittedABSD and related interest, even though developer and trustee undertakings coexist. Sign as authorised person and give designation, toCommissioner at 55 NewtonRoadRevenueHouseSingapore 307987. The undertaking is not evidence that remission was already approved or that development duties were met.
