Late payment or non-payment of Estate Duty

Historical estate-duty penalties use annualised rates rather than the ordinary income-tax penalty formula.

Source checked · 11 October 2026 Historical document

Key requirements

For deaths from 1 January 2005 before 15 February 2008, the notice normally allows thirty days to pay unpaid duty and interest. The source’s first completed-month penalty uses 6% per year, with subsequent annual-rate increases of one percentage point per completed month up to 12% per year. Its examples divide the annual rate by twelve; this is not a flat 6% charge every month. For deaths before 2005, the page states interest applies without these late-payment penalties. Check the assessment and date-specific rules. No estate-duty liability arises from a death on or after the abolition date.
