Husband-and-wife team jailed for fictitious expenses claims

IRAS publication date:

Case and status

Candid Electric and directors Foo Ming Chee and Lim Kim Wah were convicted of tax offences. The company incorrectly deducted personal handbags, jewellery and family holidays for YAs 2006–2010, receiving a S$4,000 fine and S$36,411 penalty.

Facts, amounts and outcome

Foo and Lim also assisted fictitious expense claims of S$929,460 supported by false invoices and vouchers, causing S$175,545 tax undercharged. Each admitted two of five charges. Foo received four weeks’ imprisonment and S$440,309 penalties; Lim received six months and S$587,079 penalties. The different multiples reflected different offences. Company payment does not turn private consumption into a deductible business expense.

Disclosure, reporting and rewards

IRAS encourages taxpayers to correct past errors and report suspected tax malpractices. The release says disclosure may be considered when deciding enforcement action; it is not a blanket promise of immunity. Where the release describes informant rewards, qualifying information leading to otherwise lost tax recovery may attract 15% of recovered tax, capped at S$100,000, at IRAS’ discretion. Informant identities are kept confidential. Use the official release links for its reporting and disclosure channels.
