Imprisonment and Tax Penalty for Business Partners for Evading Income Tax

IRAS publication date:

Case and status

Steelweld Construction partners Ting Joo and Tay Swee Choong were convicted of false expense claims for YAs 2010 and 2012–2014. Over S$3 million of income was understated, causing S$630,817 of total income tax undercharged.

Facts, amounts and outcome

Each faced four charges and admitted two proceeded counts. Ting received eight weeks’ imprisonment and S$515,430 penalties; Tay received eight weeks and S$659,004 penalties. Two remaining counts each were considered. Their overall alleged tax amounts were S$274,217 and S$356,600, distinct from the narrower proceeded-charge penalty bases. Fictitious partnership expenses reduced the partners’ own taxable profit shares.

Disclosure, reporting and rewards

IRAS encourages taxpayers to correct past errors and report suspected tax malpractices. The release says disclosure may be considered when deciding enforcement action; it is not a blanket promise of immunity. Where the release describes informant rewards, qualifying information leading to otherwise lost tax recovery may attract 15% of recovered tax, capped at S$100,000, at IRAS’ discretion. Informant identities are kept confidential. Use the official release links for its reporting and disclosure channels.
