Annual leave in special situations

Half-day work and long shifts

A leave day on a half-working day normally counts as a full leave day; the employer may adopt a half-day policy. The source’s Saturday 9am–1pm example still uses a full day by default. For a shift longer than eight hours, one leave day equals the actual shift: a 12-hour shift uses one day covering 12 hours.

Unused annual leave

Part 4-covered employees must be allowed to carry unused statutory leave into the next 12 months. For seven days earned in January–December 2022, unused days carry into 2023 and can expire after 31 December 2023. Excess contractual days and employees outside Part 4 follow the contract on encashment, carry-forward or expiry. Statutory leave may be forfeited for unapproved/unexplained absence exceeding 20% of working days or misconduct dismissal.

No-pay leave, marriage and compassionate leave

Unpaid leave requires employer approval where paid leave is unavailable/exhausted. Paid leave used above entitlement becomes unpaid and salary may be deducted; retain all applications. Marriage and compassionate leave have no statutory entitlement and depend on contract/agreement; annual or unpaid leave may be used instead.

Vaccination and absence without leave

The source advises paid time off for vaccination/boosters and mandatory observation during working hours, and encourages time off to accompany/observe a child. Longer absences may use childcare or annual leave. More than two continuous working days absent without approval breaches the contract: salary in lieu of notice is payable to the employer, which need not encash annual leave.
