Annual leave eligibility and entitlement

Qualification and service-year entitlement

Employment Act-covered employees qualify for paid annual leave after three months with the employer and may apply after that point. The service year begins on the first working date, not the calendar year or confirmation date.

Service anniversary and pro-rating

Starting 14 March 2013 gives 7 days for 14 March 2013–13 March 2014, 8 for the next service year and 9 for the third. For three to twelve months, including probation, or a partial later service year, use completed months ÷ 12 × annual entitlement. Round a fraction below 0.5 down and a fraction of 0.5 or more up.

Completed months and calculation example

Starting 14 March 2014 and ending 31 July completes four months through 13 July; 14–31 July is not a completed month. At a contractual 10-day annual entitlement, 4/12 × 10 = 3.33, rounded to three days.

Unpaid leave and notice-period examples

Exclude approved unpaid leave from qualifying service. For 12 annual days and one unpaid day in each of January–April, the source example uses three completed months: 3/12 × 12 = three days. Notice counts: with two unpaid weeks in March and a resignation on 1 August followed by one-month notice, the January–August example excludes March but includes August, giving 7/12 × 12 = seven days.
