Five Arrested, Fined and Jailed for Fraudulent GST Refund Claims and Money Laundering Charges

IRAS publication date:

Case and status

Five Indian nationals were convicted of fraudulent eTRS claims and removing criminal proceeds from Singapore. Each faced over 200 conspiracy charges concerning approximately S$167,253 refunds; 127 money-laundering counts across the five concerned S$112,924.

Facts, amounts and outcome

They bought jewellery invoices from other customers and used their own passports to obtain refund tickets. Annex A gives each person’s proceeded counts, tax penalties, fines and overall prison terms, reproduced below. IRAS described additional controls for higher-risk retailers, including CCTV covering ticket issuance and sale processes and marking invoices to show whether tickets were issued. Customs may physically inspect the goods; a purchased invoice does not make the claimant the genuine buyer.

GST fraud consequences described by IRAS

The release distinguishes genuine input-tax recovery from deliberate false returns: overstated input tax, omitted output tax and fictitious transactions can constitute GST evasion. The cited consequences on conviction include a penalty of three times the tax undercharged, a fine up to S$10,000 and/or imprisonment up to seven years. These are statutory possibilities described in the release, separate from the actual sentence or allegations in this case.

Criminal proceeds and money laundering

The release separately explains offences involving concealment, transfer, possession or use of criminal benefits. Its cited legislation permits a fine up to S$500,000, imprisonment up to ten years, or both upon conviction. Spending illicit tax refunds on business bills, personal assets or transfers abroad does not change their origin. The particular laundering allegations or convictions and amounts are set out in the case section above.

Tourist-refund conditions and examples

The release treats the scheme as a refund for an eligible tourist’s actual purchases taken out of Singapore. Buying another customer’s receipt, using someone else’s passport or returning refunded goods to a local person can defeat those conditions and create offences. Retailers and helpers can also face action for their participation. The eTRS tickets, airport procedures and examples in older releases describe the system at publication; current operational details remain on IRAS’ official guidance.
